Selling an inherited house in Clearwater

Clearwater is the county seat, and the main Pinellas courthouse sits downtown on Court Street. You will probably never need to set foot in it.

The short version
  • Main Pinellas courthouse: 315 Court Street, Clearwater
  • Probate filings are electronic; heirs sign with a notary where they live
  • We pay the probate cost, typically about $3,000
  • We do not buy condos, including beach condos

Why the courthouse matters less than people think

Families often assume probate means hearings in Clearwater. In practice, the Pinellas County Clerk of the Circuit Court receives filings through the Florida Courts E-Filing Portal. The probate attorney files the petition, the judge reviews it, and an order is issued. In the probates we handle, the heirs do not appear in a courtroom. They sign their paperwork in front of a notary, at home or online.

The court's job is to confirm who the heirs are. It does not set the sale price or the closing date. The heirs decide those.

We are not attorneys, and this is general information, not legal advice.

Clearwater houses we see most often

Clearwater covers a lot of ground, from the barrier island at Clearwater Beach and Island Estates to the neighborhoods around downtown and the larger planned areas like Countryside to the east. The houses that come to us through probate tend to fall into a few groups:

  • Older homes near downtown, some going back many decades, often needing roofs, electrical, and plumbing work.
  • 1960s and 1970s ranch homes in established neighborhoods, usually solid but dated inside.
  • Homes in Countryside and similar subdivisions from the 1970s and 1980s, sometimes with homeowners association rules to account for.
  • Waterfront and beach-area homes, where flood zone rules and storm damage come into play.

If the inherited property is a condo on Clearwater Beach or elsewhere, we are not the right buyer. We say that plainly so no one loses time.

Storm damage near the water

Helene and Milton in 2024 flooded and damaged homes on Clearwater Beach, Island Estates, and along the shoreline. In flood zones, the FEMA 50% rule applies: if the cost to repair a damaged house is half the structure's value or more, it has to be brought up to current flood standards before anyone can live in it again. For an estate, that can be a large expense with no clear end. We buy these houses as-is and handle that work ourselves after closing.

When there are many heirs

Some of the hardest cases we have taken on involved large families. One Tampa Bay home, left without a will, passed to 42 relatives spread across the country. A title company and a national title underwriter had declined it as too complicated. We located every heir. Twenty-eight signed voluntarily, and the rest were served and given notice under Florida partition law. No one contested. The court approved the sale, it closed in spring 2026, and all 42 heirs were paid their share.

Most Clearwater estates are far simpler than that, often two or three siblings. But if your family is large, scattered, or not in agreement, it is worth knowing that it can still be done. See our guide on inherited houses with multiple heirs.

What we pay for and what you keep

We pay the probate cost, typically about $3,000 between the independent probate attorney's fee and court costs, and it is not deducted from the heirs' share. Back taxes, code fines, and any mortgage are paid from the sale at closing. The family takes whatever matters to them from the house and leaves the rest. On a small estate that fits Florida’s summary process, the paperwork is often done within 24 to 48 hours of the signatures, and the sale typically closes about a week later. Estates that need formal administration take longer, and we will tell you honestly which one you are likely facing.

Questions families ask

Is Clearwater probate handled differently than St. Petersburg probate?
Both are in Pinellas County, part of the Sixth Judicial Circuit, and filings go through the same Clerk of the Circuit Court electronically. The process is the same county-wide.
Will you buy a house on Clearwater Beach?
We buy single-family homes and small multifamily buildings on the beach and in Island Estates, including storm-damaged ones. We do not buy condos.
My relatives and I don't all agree on selling. Can you still help?
Often, yes. We can buy one heir's fractional share, and in larger disputes Florida partition law gives a path to a court-approved sale.
